In January 2018, the government said it had worked with 70 countries covered by more than 40 EU international trade agreements and had received a positive response to its goal of ensuring the continuity of these trade relations. First, there has been less information on the government`s preparations to replace or deal with the agreements covered by the EU`s many international agreements on non-trade agreements. A report published in the Financial Times in May 2017 suggested that 759 separate eu-wide international agreements have been concluded with the UK. These include trade, regulatory cooperation, fisheries, agriculture, nuclear cooperation and cooperation in transport (including aviation). Another 168 countries are participating in the agreements. The government`s impact assessment on the impact on an agreement, published on 26 February, stated that it was “urgently considering” emergency options for which the talks have not begun, including interim and transitional mechanisms (e.g. B Memorandums of Understanding) to implement agreements on the day of withdrawal. The VA also contains a protocol on Ireland/Northern Ireland providing for a “backstop” that would leave the UK in a “single customs territory” with the EU at the end of the transition period, unless a new agreement on future relations between the UK and the EU has come into force, guaranteeing the absence of border controls between Northern Ireland and Ireland.
This is partly due to the temporary tariff regime between the UK and the EU, proposed by the government in a technical communication in June 2018. The June proposal proposed that further technical discussions with the EU be needed to find a common solution to ensure that the UK is able to fully implement the EU`s common external tariffs and allow the UK to continue to benefit from existing free trade agreements or new EU free trade agreements signed during this period. The UK currently participates in many international agreements with third countries as a member of the EU. The EU online treaty database lists 1,261 international agreements to which the EU is a member. This document was subsequently updated, reflecting the new default withdrawal date of October 31, 2019 and the progress made in reaching agreements in certain areas. Some agreements, which were not expected in time before Brexit day, are expected to come into force on 31 October. These include five fisheries agreements and another air services agreement, as well as other trade continuation agreements. However, the status of most other agreements for which the commitment has not yet been concluded or which was not expected to be in force remains unchanged. The Ministry of International Trade published a list on 21 February showing the status of negotiations on replacement agreements. He confirmed that the agreements between Japan and Turkey would not pass on the day of the withdrawal, but said that the commitment to other agreements was under way.
About a quarter of the EU`s international agreements have been considered joint agreements, as they cover the shared competences between the EU and member states. This means that they have been ratified separately by EU member states and approved at EU level. While the agreements only apply to the EU after the EU withdrawal, some legal experts have suggested that aspects of the mixed agreements could continue to apply.
